By being allowed to access this website, you enter into terms & conditions as set out by the website. The company reserves the right to add or change the terms & conditions at its sole discretion, including those relating to the use of information. You are advised to read these terms & conditions from time to time because such revised terms shall be binding on you. When you access or visit the website after the company has notified you of the said changes, you agree to be bounded by those changes.
Here we have set out some terms & conditions governing the access, use of, and downloads from this website. It also includes any files or group of files hosted on a computer and accessible by third parties through the internet protocol used to transmit files and any collection of one or more inter-related web pages or documents that can be viewed in entirety without leaving the applicable URL when viewed by a browser program through a common URL. URL means the electronic address of any document located on the web, comprising of a code or series of numbers, letters, and symbols.
- Geneva India is a Category A licensed internet and internet telephony service provider.
- We agree to supply broadband or high-speed internet access and services to the customers under the terms & conditions mentioned herein.
- When a customer avails our services, the terms & conditions mentioned there-in in addition to the ones mentioned here will apply.
- The commissioning of our services is subject to the technical feasibility of the connection and realization of payment. We are not responsible for any direct, consequential or, other forms of loss incurred or suffered by the subscriber due to the delay in installation or commissioning of our services. We will refund payments received during the events of non-feasibility.
- Service plans available to customers are fully detailed in the Price List section which has been made available to you by the company on the website. It is updated regularly with the current plan list & details. We reserve the full right to withdraw any service plan or amend the price of our entitlements without issuing a notice.
- The connection should be used for subscription purposes only, not for other purposes.
- At our discretion, customers have the option to change the plan under which they have obtained the service at such additional cost as may be decided by the company. However, such a change cannot be made in the middle of a billing cycle.
- Email service provided by the company is free of cost and on a best effort basis. Also, we reserve the right to make it chargeable in the future.
- All the terminal apparatus, including but not limited to drop cable, cable modem, Ethernet card, and any other accessories installed within or appurtenant to the premises of the customer in relation to the services, shall remain the property of the company unless expressly transferred to the customer in writing through a bill of Sale of Transfer. However, the customer shall be responsible for the safety of the said equipment and shall not damage or alter the same without the consent of the company. If the customer fails to comply with the rules, the company has full right to deduct the amount from the security deposit, without prejudice to any other remedies that the company may have. In case the modem/device or any other hardware has been sold to the customer, it will not be returnable on becoming non-functional as the company gives no guarantee or warranty for the supply of such hardware equipment. In case the customer gets the hardware repaired through the company, the cost of such repair shall be borne by the customer.
- The equipment shall remain in the custody of the customer at all times, at the premises at which the connection has been given by the company, and shall be used only to receive our services.
- If the customer fails to properly maintain the company's terminal apparatus, he/she becomes fully liable to pay the company repair or maintenance charges.
- Since the company is merely the supplier of the said equipment and not the manufacturer, it gives no guarantee or warranty of any kind, express or implied, with respect to the same.
- In the event of termination of our services by the customer, the company retains full right to recover any and all equipment belonging to it; and the customer shall permit authorized personnel of the company to effect such removal without hindrance or prejudice.
- No action, documentation, or contracts utilized or prepared by the customer for contracting with any other parties shall alienate the company's rights to recover the equipment in the event of termination or non-renewal of the agreement.
- Payment to the company can be made by A/c Payee check/DD/Online or Pay Order drawn on any local bank in favor of the company. Payment must be made on or before the due date, failing which the company shall be entitled to charge interest at the rate of 18% per annum or at the prevailing market rate of interest, if higher, on all the outstanding charges from the due date and in addition shall be entitled to discontinue the services without notice, at its sole discretion. The company shall have the full right to adjust the security amount against any outstanding bill. In the event of such adjustment, the customer shall restore the security deposit to the specified amount within 3 days, so that the security deposit is maintained at all times.
- Upon expiry, all services shall be suspended. However, the customer can get them reactivated by subscribing to our renewal pack.
- In case the customer opts for terminating services, he/she has to send a formal written termination request. The modem deposit would be refunded after adjusting outstanding bills if any. The refund will be made only by check/NEFT, irrespective of the mode of connection, in favor of the subscriber's name. Subscription fees and one-time payments, including installation and modem rental charges if any, will not be refunded.
- The customer shall be liable to pay for any excess usage beyond the subscription pack.
- The taxes payable by the customer to the company shall be according to the prevailing tax norms of the government.
- The company, at all times, endeavors to maintain an adequate and reasonable quality of the service. However, the quality of our service may be affected by factors outside our control such as weather, physical obstructions, electrical interference or faults, non-availability of poles to which the network is connected, and we shall not be liable for any consequences arising thereof including but not limited to damage to customer's PC or any other device. We shall not be obliged to grant any service credit for the disruption of services due to reasons outside our control.
- We reserve the right to verify the information/details given by our customers, in this agreement, at any time in the future, through our agents or associates. We may require the customer to provide the necessary proof.
- We retain the right to withdraw or terminate services without any prior notice in the event of:
- Wrongful, malicious, or fraudulent representation in respect of the details required by the company for the provision of services, by the customer.
- Non-payment of dues by the customer like installation charges, hire or purchase cost of the modem or other accessories, monthly subscription charges and fees, dishonor of check issued by the customer.
- Negligence on the part of customers leading to illegal, immoral, or malicious acts.
- Any attempt by the customer to customer to pass themselves off as agents, vendors, retailers, or business associates of the company unless expressly authorized by the company in writing.
- Resale or unauthorized additional connections from the connection provided by us.
- Damage to the company's equipment or terminal apparatus provided to enable the services.
- Use of services for purposes like gambling, solicitation, email attacks, the willful transmission of viruses, nuisance emailing or messaging, diffusion of pornographic or immoral material, commercial fraud, breach of law or copyright, or any other offenses.
- Any alteration in the company's network resulting in the inability to provide further services.
- We ree the right to suspend our services by giving 30 days prior notice, during technical failure, repair or modification, or testing of the services or network.
- All terms of our services shall be subject to license conditions as stipulated by the government or TRAI from time to time.
- We accept no responsibility or liability whatsoever for the commercial transactions of any nature including bookings, purchases, contracts, or agreements entered into by the customer or any other person or a firm using the connection of the customer.
- The customer may use VPN and encryption up to the bit length permitted by the Telecommunications Department.
- Agreement between the customer and the company should be duly authorized and executed and should be valid and binding and enforceable by the law.
- Device rentals shall be charged even when the account is inactive unless it is returned to us.
- After a suspension period of 90 days, your account will be deactivated and outstanding dues shall be adjusted against the security deposit.
- The above terms & conditions are subject to the review by the company from time to time.
